Medical Equipment Policy

BUSINESS ENTITY NOTICE: Vast Trades is a trade name of OMWAH, INC, a Washington State registered business (UBI 603-128-871, Washington State Reseller Permit A36450926). All references in this Policy to "Vast Trades," "we," "us," and "our" refer to OMWAH, INC doing business as Vast Trades. Registered business address: 600 S 74th Place Unit 103, Ridgefield, WA 98642.

 

This Medical Equipment Policy supplements and is incorporated by reference into our Terms of Service. It applies to all purchases of medical, laboratory, surgical, dental, and similar equipment from Vast Trades.

 

1. CONDITION OF ITEMS
2. Most medical equipment sold by Vast Trades is pre-owned, refurbished, demo, surplus, or open-box. All such items are sold AS-IS unless explicitly described as new with a written manufacturer warranty. Vast Trades does not represent that items meet OEM specifications unless explicitly stated in writing for a specific item.

2. RESELLER, NOT MANUFACTURER

Vast Trades is a reseller of pre-owned medical equipment. Vast Trades is not a manufacturer, remanufacturer, or refurbisher as those terms are defined by FDA's Quality System Regulation (21 CFR Part 820). Vast Trades does not significantly alter the performance or safety specifications of items sold and is not subject to OEM regulatory obligations.

 

3. FDA AND REGULATORY COMPLIANCE - BUYER'S RESPONSIBILITY

Vast Trades does not represent or warrant that any item is currently cleared, approved, listed, or registered by the U.S. Food and Drug Administration (FDA), the Centers for Medicare and Medicaid Services (CMS), or any other federal, state, or foreign regulatory body.

 

Buyer is solely responsible for: (a) determining the regulatory status of each item before use; (b) complying with the Federal Food, Drug, and Cosmetic Act (FFDCA), 21 CFR Parts 800-898, 21 CFR Part 820, and Medical Device Reporting (MDR) regulations; (c) obtaining any required state-level medical device distributor licenses, practitioner certifications, or institutional permits; (d) verifying compliance with applicable EPA, DOT, DEA, OSHA, and similar regulations.

 

4. PRESCRIPTION DEVICES (21 CFR 801.109)

Certain items are classified by the FDA as prescription devices and may only be purchased, sold, or used by or on the order of a licensed practitioner. By placing an order for such items, you represent that you are a licensed practitioner, an authorized representative of one, or a qualified healthcare institution. Vast Trades reserves the right to require proof of license before fulfilling orders for prescription devices.

 

5. SINGLE-USE DEVICES

Items labeled "Single Use" by the original manufacturer are not intended for reuse. Reprocessing of single-use devices (SUDs) is regulated by the FDA and may only be performed by FDA-cleared third-party reprocessors. Buyer is responsible for compliance with all FDA Single-Use Device regulations and shall not reuse any SUD on a patient without proper FDA-cleared reprocessing.

 

6. NOT FOR CLINICAL USE WITHOUT CERTIFICATION

Items sold by Vast Trades are intended for one or more of the following uses, at the buyer's discretion and at the buyer's risk: (a) replacement parts or components for existing devices; (b) refurbishment, repair, or remanufacture by qualified personnel; (c) research, educational, training, or demonstration purposes; (d) veterinary use where regulatorily permitted; (e) clinical use only after independent inspection, re-calibration, sterilization, re-certification, and biomedical engineering review by qualified personnel.

 

Pre-owned medical devices may not be safe for direct patient use until properly inspected and certified by the buyer. Buyer accepts full responsibility for determining fitness for intended use.

 

7. FDA RECALL VERIFICATION

Buyer is responsible for checking the FDA recall database for any item before placing it into clinical use. The FDA recall database is available at https://www.accessdata.fda.gov/scripts/ires/index.cfm. Vast Trades makes no representation that items have not been or will not be subject to FDA recall.

 

8. HIPAA AND PATIENT DATA

Pre-owned medical devices may contain residual patient data, protected health information (PHI), or other sensitive information. Buyer is solely responsible for ensuring that any such data is removed, sanitized, or destroyed in compliance with the Health Insurance Portability and Accountability Act (HIPAA), the HITECH Act, and applicable state laws before reuse, resale, or disposal. Vast Trades makes no representation that any device has been sanitized of PHI and recommends that buyer perform a NIST 800-88 compliant data sanitization before use.

 

9. WARRANTY DISCLAIMER

Except where explicitly stated in writing for a specific item, items sold by Vast Trades are sold WITHOUT WARRANTY of any kind, express or implied, including but not limited to warranties of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

 

10. ASSUMPTION OF RISK

Buyer assumes all risk associated with the purchase, transport, storage, use, refurbishment, resale, and disposal of items purchased from Vast Trades. Buyer agrees that Vast Trades shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to any item sold.

 

11. INDEMNIFICATION

Buyer agrees to indemnify, defend, and hold harmless Vast Trades from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from buyer's use, misuse, or resale of any item, including but not limited to claims arising from clinical use of a medical device without proper certification or regulatory compliance.

 

12. THIRD-PARTY MANUFACTURER TRADEMARKS

References to manufacturer brands such as Medline, Welch Allyn, Carl Zeiss, Waters, Agilent, Stryker, Olympus, GE Healthcare, Philips, Siemens, and others are for descriptive purposes only and remain the property of their respective owners. Vast Trades is not affiliated with, endorsed by, or sponsored by these manufacturers unless explicitly stated.
