BUSINESS ENTITY NOTICE: Vast Trades is a trade name of OMWAH, INC, a Washington State registered business (UBI 603-128-871, Washington State Reseller Permit A36450926). All references in these Terms to "Vast Trades," "we," "us," and "our" refer to OMWAH, INC doing business as Vast Trades. Registered business address: 600 S 74th Place Unit 103, Ridgefield, WA 98642.

2. Welcome to Vast Trades. The terms "we," "us," "our," and "Vast Trades" refer to Vast Trades, located in Ridgefield, Washington, USA, operating the website vasttradesstore.com and related services (the "Services"). The terms "you," "your," "customer," and "buyer" refer to the user, purchaser, or visitor of the Services. By accessing or using the Services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Services.

2. ELIGIBILITY AND ACCOUNT

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. If purchasing on behalf of a business or organization, you represent that you have authority to bind that entity. You agree to provide accurate information and keep your account credentials secure. You are responsible for all activity under your account.

 

3. PRODUCTS AND DESCRIPTIONS

Vast Trades sells new, refurbished, pre-owned, and surplus medical, laboratory, dental, industrial, automotive, and general merchandise. Most items are sold AS-IS unless explicitly described as new or warranted. Product descriptions, images, and specifications are provided in good faith but may contain errors, omissions, or inaccuracies. Buyer is responsible for verifying suitability before purchase.

 

4. PRICING AND PAYMENT

All prices are in US dollars. We reserve the right to change pricing at any time. Prices do not include applicable taxes, duties, or shipping unless stated. Payment is due at time of order. We reserve the right to refuse or cancel any order, including for suspected fraud, pricing errors, or stock unavailability.

 

5. MEDICAL EQUIPMENT DISCLAIMER (READ CAREFULLY)

By purchasing medical, laboratory, surgical, or dental equipment from Vast Trades, you acknowledge and agree to the following:

 

(a) AS-IS SALE. All medical equipment, including but not limited to surgical instruments, diagnostic devices, imaging equipment, laboratory instruments, dental equipment, and related accessories, is sold AS-IS and AS-AVAILABLE, WITHOUT WARRANTY of any kind, express or implied, including but not limited to warranties of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement, except where explicitly stated in writing for a specific item.

 

(b) NOT FOR DIRECT PATIENT OR CLINICAL USE WITHOUT CERTIFICATION. Items sold by Vast Trades are intended for use as components, replacement parts, refurbishing, research, educational, or veterinary purposes, or for use by qualified professionals who have independently verified the device's safety, function, regulatory status, and suitability. Pre-owned medical devices may require inspection, re-calibration, sterilization, re-certification, or biomedical engineering review before any clinical use on human patients. Buyer is solely responsible for ensuring any device is fit for its intended use.

 

(c) RESELLER, NOT MANUFACTURER. Vast Trades is a reseller of pre-owned, refurbished, and surplus equipment. Vast Trades is not a manufacturer, remanufacturer, or refurbisher in the sense defined by FDA's Quality System Regulation (21 CFR Part 820). Vast Trades does not significantly alter the performance or safety specifications of items sold.

 

(d) FDA AND REGULATORY COMPLIANCE. Vast Trades does not represent or warrant that any item is currently cleared, approved, listed, or registered by the United States Food and Drug Administration (FDA) or any other federal, state, or foreign regulatory body. Buyer is solely responsible for: (i) determining the regulatory status of any item; (ii) complying with all applicable federal, state, and local laws and regulations, including the Federal Food, Drug, and Cosmetic Act, 21 CFR Parts 800-898, 21 CFR Part 820 (Quality System Regulation), and the Medical Device Reporting regulations; (iii) obtaining any required licenses, permits, certifications, or authorizations before using, reselling, distributing, or otherwise handling the item.

 

(e) FDA RECALL VERIFICATION. Buyer is responsible for verifying that any item has not been subject to an FDA recall or safety alert before clinical use. The FDA recall database is available at https://www.accessdata.fda.gov/scripts/ires/index.cfm. Vast Trades makes no representation that items are not subject to a current or future recall.

 

(f) PRESCRIPTION DEVICES (21 CFR 801.109). Some items are classified as prescription devices under 21 CFR 801.109 and may only be purchased, sold, or used by or on the order of a licensed practitioner. By placing an order, you represent that you are a licensed practitioner, an authorized representative of one, or a qualified institution where applicable. Vast Trades reserves the right to require proof of license before fulfilling certain orders.

 

(g) SINGLE-USE DEVICES (SUDs). Items labeled "Single Use" by the original manufacturer are not intended for reuse. Reprocessing of single-use devices is regulated by the FDA and may only be performed by FDA-cleared third-party reprocessors. Buyer is responsible for compliance with all FDA Single-Use Device regulations.

 

(h) HIPAA AND PATIENT DATA. Pre-owned medical devices may contain residual patient data. Buyer is solely responsible for ensuring that any patient-identifying or protected health information is removed, sanitized, or destroyed in compliance with the Health Insurance Portability and Accountability Act (HIPAA), the HITECH Act, and any applicable state laws before reuse, resale, or disposal. Vast Trades makes no representation that any device has been sanitized of patient data.

 

(i) NO MEDICAL ADVICE. Nothing on the Services, including product descriptions or customer service communications, constitutes medical, clinical, regulatory, or legal advice.

 

(j) BUYER ASSUMES ALL RISK. Buyer assumes all risk associated with the purchase, use, transport, storage, refurbishment, resale, and disposal of items purchased from Vast Trades. Vast Trades disclaims all liability for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to the use, misuse, malfunction, regulatory non-compliance, or failure of any item.

 

6. HAZARDOUS MATERIALS AND CONTROLLED SUBSTANCES

Some items may contain or be classified as hazardous materials, controlled substances, or precursors thereto. Buyer is responsible for complying with all applicable transport, storage, handling, and disposal regulations, including those issued by the U.S. Department of Transportation (DOT), the Environmental Protection Agency (EPA), the Drug Enforcement Administration (DEA), and analogous state and local agencies.

 

7. SHIPPING AND RISK OF LOSS

Risk of loss and title pass to the buyer upon delivery to the carrier (FOB Origin), unless otherwise agreed in writing. Shipping times are estimates only. We are not responsible for carrier delays or shipping damage where delivery was accepted without notation. See our Shipping Policy for details.

 

8. RETURNS

Returns are governed by our separate Return and Refund Policy. Certain items, including opened sterile or single-use medical supplies, custom orders, hazardous materials, and items restricted by law, are non-returnable.

 

9. INTELLECTUAL PROPERTY

All content on the Services, including text, images, logos, product photographs, software, and design, is owned by Vast Trades or its licensors and is protected by U.S. and international intellectual property laws. You may not reproduce, modify, distribute, or publicly display any content without our prior written permission.

 

10. THIRD-PARTY TRADEMARKS

References to third-party brands (such as Medline, Welch Allyn, Carl Zeiss, Waters, Agilent, Stryker, and others) are for descriptive purposes only and remain the property of their respective owners. Vast Trades is not affiliated with, endorsed by, or sponsored by these manufacturers unless explicitly stated.

 

11. DISCLAIMER OF WARRANTIES

EXCEPT AS EXPRESSLY STATED IN WRITING FOR A SPECIFIC ITEM, THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

 

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VAST TRADES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING OUT OF YOUR USE OF THE SERVICES OR ANY PRODUCT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

 

13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Vast Trades, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of: (a) your use or misuse of the Services or any product; (b) your violation of these Terms; (c) your violation of any applicable law or regulation, including FDA, HIPAA, OSHA, DOT, EPA, or DEA regulations; (d) any death, personal injury, or property damage arising from clinical use of medical devices without proper certification.

 

14. GOVERNING LAW AND VENUE

These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-laws principles. Any dispute shall be brought exclusively in the state or federal courts located in Clark County, Washington.

 

15. CHANGES TO TERMS

We may update these Terms at any time. Material changes will be indicated by an updated "Last updated" date. Your continued use of the Services after changes constitutes acceptance of the revised Terms.

 

16. SEVERABILITY

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

 

17. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Shipping Policy, and Return and Refund Policy, constitute the entire agreement between you and Vast Trades.
